{"id":1496,"date":"2021-08-26T02:37:50","date_gmt":"2021-08-26T00:37:50","guid":{"rendered":"https:\/\/carolinesimard.ca\/?p=1496"},"modified":"2021-11-16T21:44:55","modified_gmt":"2021-11-17T02:44:55","slug":"what-exactly-is-the-prescription","status":"publish","type":"post","link":"https:\/\/carolinesimard.ca\/en\/what-exactly-is-the-prescription\/","title":{"rendered":"What exactly is the &#8220;prescription&#8221;?"},"content":{"rendered":"\n<p>Make no mistake,\nthis article will not discuss of the prescriptions that your doctor writes for\nyou following his diagnosis. Instead, this article will explain the legal\nconcept commonly known as \"prescription\".<\/p>\n\n\n\n<p>In law, there\nare two types of prescription: extinctive and acquisitive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Extinctive\nprescription<\/strong><\/h2>\n\n\n\n<p>\"Extinctive prescription is a means of\nextinguishing a right which has not been used or of pleading the\nnon-admissibility of an action.\" (section 2921 of Civil Code of Qu\u00e9bec)<\/p>\n\n\n\n<p>In clearer terms, the law sets time limits in which\nyou must act to exercise your rights in court or to simply keep them. If you do\nnot exercise them in time, you risk losing them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Here are some examples :<\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>When you obtain a judgment in your favour, you have\nten (10) years to exercise this right. Otherwise, after that time, your\njudgment can no longer be enforced against your debtor.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>If a person owes you money, but refuses or neglects to\npay you, you must file a judicial demand before the expiry of a three (3) years\nperiod from the date the debt was incurred, when it is due. By default, the\ndebt is prescribed automatically and you can say goodbye to your money.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>When the beneficiary of a right-of-way does not use it\nfor a period of more than ten (10) years, the right-of-way is extinguished. The\nbeneficiary will have to re-negotiate a right of way with the owner of the\nproperty or another neighbor. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>In matters of defamation, if someone damages your\nreputation by spreading false information about you, you have one (1) year from\nthe day on which you learned of the defamation to file a judicial demand\nagainst this person. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>In municipal matters, it is even more severe: if a\nmunicipality has committed a fault against you and you want to claim monetary\ncompensation, there are specific requirements and very short deadlines that\nmust be met. Generally, you must send a written notice within 15 or 60 days\n(depending on the law applicable to the municipality) following the act\nreproached and file a legal claim within six (6) months.<\/li><\/ul>\n\n\n\n<p>It is important to talk to a lawyer without delay when\nyou want your rights respected. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Acquisitive Prescription <\/strong><\/h2>\n\n\n\n<p>\u201cAcquisitive\nprescription is a means of acquiring a right of ownership, or one of its\ndismemberments, through the effect of possession\u201d (section 2910 of Civil Code\nof Qu\u00e9bec)<\/p>\n\n\n\n<p>The delay to acquire an immovable by acquisitive\nprescription is ten (10) years. Thus, if you possess as an owner and use a part\nof the immovable for more than 10 years in a peaceful, continuous, public and\nunequivocal manner, you could ask to be officially recognized as the owner of\nthis part of the immovable. <\/p>\n\n\n\n<p>The criteria mentioned above must be respected in\norder to acquire by prescription. However, and most importantly, you can only\nacquire this part of the immovable as a result of a judicial demand. <\/p>\n\n\n\n<p>It is also possible to prescribe a movable.
