{"id":1521,"date":"2021-09-16T06:08:42","date_gmt":"2021-09-16T04:08:42","guid":{"rendered":"https:\/\/carolinesimard.ca\/?p=1521"},"modified":"2022-02-22T22:47:21","modified_gmt":"2022-02-23T03:47:21","slug":"insurance-deceits-or-false-statement","status":"publish","type":"post","link":"https:\/\/carolinesimard.ca\/en\/insurance-deceits-or-false-statement\/","title":{"rendered":"Insurance: deceits or false statement?"},"content":{"rendered":"\n<p>The <em>Civil Code of Quebec<\/em> provides a general\nobligation for the insured to always cooperate with his insurer, particularly\nduring the post-loss investigation. This often means that the insured must\nrepeatedly explain the circumstances surrounding the loss : the initial call notifying\nthe loss, the police report, the version given to the claims adjuster representing\nthe insurer and, if required, in the insurer\u2019s subsequent demands. <\/p>\n\n\n\n<p>What if these different statements contain small\ndifferences? Does this automatically mean that your insurer can refuse to\ncompensate you for the loss that occurred, due to a lack of cooperation? <\/p>\n\n\n\n<p>First, rest assured that the answer to this question\nis no. From a legal point of view there is a significant difference between false\nstatements and deceitful representations. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Distinguishing the false from the deceits<\/h3>\n\n\n\n<p>Indeed, it is only when the insured makes deceitful representations\nthat the insurer is justified in denying cover, whereas simple false statements\ndo not lead to the loss of the right to compensation. What is the difference? <\/p>\n\n\n\n<p>Case law shows that not everything that is false is\nnecessarily deceitful. In order to be qualified as a deceitful representation,\nthe insured must have the intention to fool the insurer, with the aim of\nobtaining the insurance indemnity in fraud of the latter's rights. <\/p>\n\n\n\n<p>Courts have held that an omission, a simple exaggeration,\na lack of accuracy, a mistake, or the failure to answer exactly the same thing\nto repeated questions in deferred interrogatories may indeed represent false\ndeclarations, without however being a deceitful representation. <\/p>\n\n\n\n<p>For example, if the time at which you declare becoming\naware of the loss changes from one version to another, in the absence of an\nintention to fool the insurer, these are insufficient contradictions to justify\nthe refusal of compensation.<\/p>\n\n\n\n<p>On the contrary, pure and simple inventions regarding\nthe circumstances of the loss, the origin or value of the goods affected, made in\nthe purpose of collecting the insurance indemnity and increasing the amount\npaid by the insurer, are deceitful representations sufficient to forfeit the\nright to indemnity.&nbsp; <\/p>\n\n\n\n<p>It belongs to the insurer to prove clear malicious\nintent on the part of the insured and the denial of compensation cannot be\nbased on mere suspicion. In the absence of such proof and despite certain\ncontradictions, the insurer is obliged to compensate the insured for the loss\nsuffered.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Focus on transparency<\/h3>\n\n\n\n<p>It is important to remember that the insured is\nlegally bound to always act honestly and in good faith. He is obliged to inform\nthe insurer of everything he knows about the circumstances of the loss and the\nextent of the damage suffered, as well as to provide all the documents\nrequested for the investigation.
