The practice is all the rage and has grown\nin popularity in recent years, due to the variety of rental accommodation on\noffer at competitive prices. The downside: municipalities are having to contend\nwith an upsurge in illegal tourist accommodation on their territory. Which is\nwhy Qu\u00e9bec has been forced to tighten the regulations on this practice, due to\nthe abusive use made by many owners.<\/p>\n\n\n\n<p>On the one hand, operating a short-term tourist accommodation provides a\nsource of income for the landlord, offers benefits for local communities and\ntourists, and contributes to the expansion and diversification of the\naccommodation offer throughout Qu\u00e9bec. On the other hand, it exacerbates the\nhousing crisis, causes nuisance to residents (noise, comings and goings,\nincreased crime), leads to accelerated deterioration of properties and\ncontributes to the phenomenon of overtourism.<\/p>\n\n\n\n<p>Since municipalities lack the tools needed to manage the rapid growth in short-term tourist accommodation, the Quebec government has passed several laws and regulations in recent years such as: the <em><a rel=\"noreferrer noopener\" aria-label=\"Regulation to amend the Regulation respecting tourist accommodation establishments (s\u2019ouvre dans un nouvel onglet)\" href=\"https:\/\/www.publicationsduquebec.gouv.qc.ca\/fileadmin\/gazette\/pdf_encrypte\/lois_reglements\/2024A\/106905.pdf\" target=\"_blank\">Regulation to amend the Regulation respecting tourist accommodation establishments<\/a><\/em>, the <em><a rel=\"noreferrer noopener\" aria-label=\"Act to establish a new development regime for the flood zones of lakes and watercourses, to temporarily grant municipalities powers enabling them to respond to certain needs and to amend various provisions (s\u2019ouvre dans un nouvel onglet)\" href=\"https:\/\/www.publicationsduquebec.gouv.qc.ca\/fileadmin\/Fichiers_client\/lois_et_reglements\/LoisAnnuelles\/en\/2021\/2021C7A.PDF\" target=\"_blank\">Act to establish a new development regime for the flood zones of lakes and watercourses, to temporarily grant municipalities powers enabling them to respond to certain needs and to amend various provisions<\/a><\/em>, the <em><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/en\/pdf\/cs\/H-1.01.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Tourist Accommodation Act (s\u2019ouvre dans un nouvel onglet)\">Tourist Accommodation Act<\/a><\/em> and, on September 1, 2023, the <em>Act to fight illegal tourist accommodation<\/em>, which prohibits the operation of a short-term rental establishment in a prohibited zone, and ensures that the capacity limit for rental units is respected and complies with regulations.<\/p>\n\n\n\n<p>Municipalities have also adopted various zoning regulations, for\nexample, restricting the zones in which short-term tourist establishments are\npermitted, or limiting the number of tourist accommodation residences per zone,\nor establishing a ban depending on the type of establishment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Requirements <\/h2>\n\n\n\n<p>There are several requirements to be met in order to operate a short-term tourist accommodation, including having a registration certificate issued by the <a href=\"https:\/\/citq.qc.ca\/en\/index.php\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Corporation de l'industrie touristique du Qu\u00e9bec (s\u2019ouvre dans un nouvel onglet)\">Corporation de l'industrie touristique du Qu\u00e9bec<\/a> (CITQ). This certificate includes several information such as the registration number, the address and category of the establishment, the number of rental units and the certificate's date of issue and expiry. The registration certificate must be displayed in public view, included in all advertising, and given to the operators of digital transactional hosting platforms, who in turn must verify its validity.<\/p>\n\n\n\n<p>Before applying to the CITQ for registration, check with your\nmunicipality or regional county municipality to ensure that short-term rentals\nare authorized (zoning, permits, emergency plan, etc.), and obtain a notice of\ncompliance signed by the municipality confirming that the proposed use is\nauthorized. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Possible sanctions<\/h2>\n\n\n\n<p>Authorities have the power to issue fines in cases of non-compliance.\nThese fines can be very costly (link in French):<\/p>\n\n\n\n<p><a href=\"https:\/\/www.quebec.ca\/tourisme-et-loisirs\/hebergement-touristique-courte-duree\/infractions-et-amendes\">https:\/\/www.quebec.ca\/tourisme-et-loisirs\/hebergement-touristique-courte-duree\/infractions-et-amendes<\/a><\/p>\n\n\n\n<p>Therefore, before renting out your residence for the holidays, make sure you meet all the requirements and are well informed about the obligations associated with it.
